2 men handed 30-month prison terms for drug possession

AMMAN — The Court of Cassation has upheld a July 2021 State Security Court (SSC) ruling, sentencing two men to reduced prison terms after convicting them of possessing illegal narcotics in Amman in January.

The court declared the defendants guilty of various illegal narcotics on January 12 in Shafa Badran neighbourhood, and handed them a three-year prison term each.

However, the SSC decided to reduce the sentence to 30 months each to “give the defendants a second chance in life”.

The court also ordered the defendants to pay each JD3,000 in fines.

Court documents said the defendants were in possession of various illegal narcotics. 

Anti-Narcotics Department (AND) agents received a tip-off that the defendants were in possession of the illegal drugs and raided the house of one of them, court papers said.

Upon searching the defendant’s home, court papers said, the AND personnel found "Captagon pills, hasheesh and other manufactured illegal substances". 

“AND agents also found a hasheesh cigarette that was lit and left on the table,” court documents added.

The defendants confessed willingly to “buying and storing the illegal narcotics in one of the defendant’s houses to sell them to people in his area”, court documents said.

The defendants contested the SSC’s ruling through their lawyers, who argued that the court “did not provide solid evidence to implicate their clients”.

Meanwhile, the SSC prosecution office asked the higher court to uphold the sentence and the fine imposed on the defendants.

The higher court maintained that the SSC had followed the proper procedures in issuing the sentences against the defendants.

“It was clear to the court that the defendants confessed willingly to possessing the illegal drugs,” the higher court said.

The Court of Cassation judges presiding were Mohammad Ibrahim, Majid Azab, Hayel Amr, Fawzi Nahar and Ibrahim Abu Shamma.
