Man declared innocent in murder case

AMMAN — The Court of Cassation has upheld a March Criminal Court ruling that declared a man innocent of murdering another man following “a heated argument” over debt in Mafraq in October 2017.

The Criminal Court also found a second man guilty of misdemeanour in the beating of a 43-year-old man following “a heated argument” and ordered his release because he benefitted from a general amnesty.

According to court papers, one of the defendants owed the victim some money, which he failed to “pay back”.

On October 5, the court maintained, the victim drove to the defendants’ home to demand his money.

An argument ensued between the three men, according to court documents.

“The victim grabbed one of the defendants arm while driving his vehicle slowly, prompting the other defendant to jump inside to release his brother,” court papers said.

 The defendant in the vehicle beat up the victim who all of a sudden “lost control of his vehicle and headed towards a deep ditch”, according to court documents.

“The defendant jumped from the moving vehicle, which fell into the steep ditch," the court said.

The victim’s vehicle was pulled out by emergency police units and he was declared dead on the scene, the court maintained.

A team of government physicians determined that the victim died of heart failure and that the “defendants were not responsible for his death”, the court papers stated. 

The higher court ruled that the Criminal Court proceedings had been accurate and that the defendant was given the appropriate ruling.

"It was proven to the court that the defendants’ actions did not cause the death of the victim based on the forensic experts’ report," according to court documents.

The Cassation Court bench consisted of judges Mohammad Ibrahim, Majid Azab, Nayef Samarat, Hayel Amr and Fawzi Nahar.
